Welcome to SCOOP Delivery ("SCOOP," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of the SCOOP mobile application and delivery services. By creating an account or using our services, you agree to these Terms.
SCOOP is an on-demand delivery platform connecting customers with local smoke shops in Tucson, Arizona. We facilitate the ordering and delivery of tobacco products and smoking accessories from partner retail locations ("Stores") to your specified delivery address.
SCOOP is a technology platform that facilitates transactions between customers and Stores. We are not the seller of the products you purchase. Products are sold by the Store that fulfills your order.
To use SCOOP, you must create an account and provide accurate, complete information including your full name, email address, phone number, date of birth, and a valid delivery address within our service area.
Age Verification: You are required to upload a photo of a valid government-issued ID to verify your age. Additionally, our delivery drivers will verify your age at the time of delivery. You must present a valid ID matching the account holder at every delivery. Orders cannot be left unattended or delivered to minors.
Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account.
Placing Orders: All orders are subject to product availability, store hours, and delivery area restrictions. We reserve the right to cancel or refuse any order for any reason, including suspected fraudulent activity or age verification failure.
Delivery Area: We currently deliver within the Tucson, Arizona metropolitan area. Your delivery address must be within range of an active Store location.
Delivery Fee: A flat delivery fee of $4.99 applies to all orders. This fee is subject to change with notice.
Delivery Time: Estimated delivery times are approximate and not guaranteed. Factors including order volume, distance, traffic, and product preparation may affect delivery times.
Receiving Deliveries: You or a designated recipient (who must also be 21+) must be present to receive your delivery in person. The delivery driver will verify the recipient's age with a valid government-issued photo ID. If age cannot be verified, the delivery will not be completed and you will be charged for the order.
Product Prices: Prices are set by SCOOP and are displayed in the app at the time of ordering. Prices may differ from in-store prices. All prices are in US dollars.
Taxes: Applicable sales taxes are calculated and added to your order total as required by law.
Payment: We accept credit cards, debit cards, Apple Pay, and Google Pay through our secure payment processor, Stripe. Payment is collected at the time your order is placed.
Tips: Tips for delivery drivers are optional and greatly appreciated. 100% of tips go directly to the driver.
Cancellation by Customer: You may cancel an order before the Store begins preparing it. Once preparation has started, cancellation may not be possible.
Cancellation by SCOOP: We may cancel an order if the product is unavailable, the Store is unable to fulfill it, no driver is available, or if we are unable to verify your age or identity.
Refunds: Refund eligibility is determined on a case-by-case basis. If you receive incorrect or damaged products, contact our support team through the in-app chat for resolution. Refunds, when approved, will be returned to the original payment method.
SCOOP offers a loyalty points program. Points are earned on eligible purchases and can be redeemed for rewards as described in the app. We reserve the right to modify, suspend, or terminate the loyalty program at any time. Points have no cash value and cannot be transferred.

The SCOOP name, logo, mascot, and all associated branding, design, and content are the property of SCOOP and are protected by intellectual property laws. You may not use, reproduce, or distribute our intellectual property without written permission.
SCOOP is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the app will be uninterrupted, error-free, or available at all times. We are not responsible for the quality of products sold by our Store partners.
To the fullest extent permitted by law, SCOOP and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.
You agree to indemnify and hold harmless SCOOP from any claims, damages, or expenses arising from your violation of these Terms, your misuse of the services, or your violation of any law or regulation.
These Terms are governed by the laws of the State of Arizona without regard to conflict of law principles. Any disputes shall be resolved in the courts of Pima County, Arizona.
We may update these Terms from time to time. Material changes will be communicated through the app or via email. Your continued use of SCOOP after changes take effect constitutes acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
